Making Cosmetics

The discussion on a possible classification of Titanium Dioxide as a CMR Cat 2 substance by inhalation under the chemical regulation (CLP) is still ongoing. Where do we stand today? Several proposals to
address adverse effects of Titanium Dioxide during inhalation are under discussion. Currently the
positions of the EU COM and the Member States are diverging.

What are the consequences for the cosmetic industry? The use of CMR substances are forbidden under Art. 15 of the Cosmetics Regulation 1223/2009. How is the cosmetic industry prepared for a possible classification of Titanium Dioxide? A consortium is taking care of all aspects under the Cosmetics Regulation now.

Nanomaterials are still under discussion in the EU – perhaps even more than a few years ago. From a
regulatory perspective nothing has changed during the last years. But the perception in the media and at national authorities especially in France turns out to become more precarious.

The Catalogue of Nanomaterials in cosmetics is still open for further discussion but has no direct impact on the market so far.

For an update on nanomaterials the EU Observatory for Nanomaterials (EUON) on the ECHA platform is a very informative tool including actual news on nanomaterials in general but also regarding uses, safety, regulation, R&D and on international activities.
